Samenvatting Materieel Strafrecht
Materieel strafrecht: welke gedragingen zijn strafbaar en welke straffen staan hierop.

Kenmerken strafrecht:
-Monopoliepositie overheid
-Verbod en tegengaan van eigenrichting
-Straf als vergelding of resocialisatie
-Straf als ultimum remedium (het laatste redmiddel)

Straftheorieën
-Absolute theorie: vergelding
-Relatieve theorie: generale en speciale preventie
Absoluut kijkt naar het verleden en relatief naar de toekomst (welk effect willen we bereiken). Dit
zijn de twee uitersten, in de praktijk vaak de verenigingstheorie dus een beetje van beide.

Legaliteitsbeginsel (bij materieel): straf moet berusten op een voorafgaande wettelijke strafbepaling
(art. 1 Sr)
Nulla Poena sine praevia lege poenali: geen straf zonder schuld. Kent een aantal subregels:
-De straf moet berusten op een wet in formele zin
-Het verbod van terugwerkende kracht
-Bestimmtheitsgebot (lex certa): rechtszekerheid, strafbepalingen moeten zo specifiek mogelijk zijn.
-Het verbod van analogische interpretatie: te ruim interpreteren

Geen straf zonder schuld: kijk naar de verwijtbaarheid. Verdachte is onschuldig totdat het tegendeel
door de rechter is vastgesteld (art. 6 EVRM).

Opbouw strafbaar feit
-Menselijke gedraging
-delictsomschrijving  bestanddeel
-wederrechtelijkheid  element
-schud  element

Gedraging: is een gewilde spierbeweging (hoeft niet op dat moment te zijn, voorbeeld bij
vergiftiging).
Soms is iets nalaten strafbaar (bijvoorbeeld art. 450 Sr)

Delictsomschrijving: moet zijn opgenomen in de wet, bestaat uit bestanddelen.

Wederrechtelijkheid en schuld: dit word geacht aanwezig te zijn, maar verdachte kan aantonen dat
dit niet het geval is. Soms zijn wederrechtelijkheid en schuld geen elementen, maar bestanddelen als
het deel uitmaakt van de delictsomschrijving.

1. Is het tenlastegelegde feit bewezen? Nee dan vrijspraak op grond van art. 352 lid 1 SV.
2. Is het bewezenverklaarde strafbaar (kwalificatievraag)? Nee OVAR op grond art. 352 lid 2 SV.
3. Is verdachte strafbaar? Nee OVAR op grond van art. 352 lid 2 SV.
4. Welke straf en/of maatregel? Strafoplegging art. 351 Sv.
